The following Terms and Conditions form the basis of your contract with Knap Tours LTD (hereinafter referred to as “Knap Tours”). Please read them carefully as they are legally binding.
1. APPLICATION
All enquiries, quotations, programmes, bookings and services provided by or on behalf of Knap Tours are subject to these Terms and Conditions.
2. THE CLIENT AND AUTHORITY
Whoever requests a quotation or information or receives any type of service. It is understood that they have read, understood and accepted the Terms and Conditions.
3. THIRD PARTY SERVICES AND PROVIDERS
We offer clients travel, transfers, tours, accommodation, activities, excursions, flights or other services. Whether acting as itself or as an Agent for participating Suppliers, or for associates (referred to as “Suppliers”).
Knap Tours represents the Suppliers and accordingly accepts no liability whatsoever for any loss, damage, injury, illness, illness, harm or death which any Customer may suffer as a result of any act or omission on the part of the Suppliers in performing their obligations. Whether in connection with travel arrangements, accommodation or otherwise unless, in the case of injury or death, it is due to the Provider’s negligent act or omission.
The contract with the Supplier shall constitute the sole contract between the Supplier and the Client. Any right of recourse shall be solely against the Supplier. Your Travel Agent will provide the Customer with the identity and terms and conditions of all Suppliers relevant to the Customer. It is the responsibility of the Customer to familiarize themselves with the Supplier’s Terms and Conditions.
4. PASSPORTS AND CHILDREN
These tickets are subject to contracts with the Airlines and may have very strict requirements regarding changes, departures, cancellation….
As a customer you are responsible for consulting all applicable terms and conditions set forth by the airlines prior to paying for tickets. Also note that if your flight/itinerary consists of more than one flight/ticket, you are not authorized to use such tickets out of sequence or to “skip” one. This would void the continuity of the trip/itinerary.
No Show’ may result in the ticket being cancelled and/or a cancellation fee being charged to the Customer. The Air Terms and Conditions shall constitute the sole contract between the carrier and the Customer, and any right of appeal the Customer may have shall be solely against the airline in accordance with Air T & C’s terms. The retention of boarding passes and other such related documents, such as passports, is the sole responsibility of the customer. Tickets are only refundable according to the terms and conditions of the airline at the time of booking.
5. CARS AND VEHICLE RENTAL
The Car Rental is bound by contracts with the Car Rental Companies. It is the Customer’s responsibility to enquire about the Terms and Conditions applicable by the Company before making payment. The customer will be responsible for all traffic fines and toll fees. It is important to always return the vehicle with a full tank, otherwise a charge will be made.
It is advisable to check the vehicle thoroughly with a representative of the rental company upon pick-up and return. Ensure that any damage or deficiencies that the vehicle may have are reported, specified and shared with that representative. The Car hire voucher and reservation number shall constitute the sole contract between the Car hire company and the Customer. Any right of recourse the Customer may have shall be solely against the Car hire company.
6. DEPOSIT AND RESERVE
Once the client has requested a travel proposal verbally, by email or via the website, Knap Tours will prepare a travel programme accordingly. A deposit of 60% of the total cost of the trip including flights will be required. No booking will be confirmed without receipt of the deposit and written confirmation of acceptance of the quotation.
7. PAYMENT AND PAYMENT TERMS
In case of payment by bank transfer, bank charges shall be borne by the customer. Upon presentation of the invoice, to complete the reservation and confirm the trip, payment of 60% of the total amount is required. The remaining 40% of the total amount to complete the final payment is due 30 days before the start of the trip. Hence, If the final payment is not received on time, the trip will be cancelled. Moreover, If the Client does not proceed with the payment 24 hours after Knap Tours has sent the invoice and the price of the quoted flights increases, the Client will be responsible for this price increase and the difference will be borne by the Client.
8. PRICES
Prices are quoted according to the daily exchange rate. Until Knap Tours has received payment in full, it may charge any fluctuations to the Customer’s account. The Customer agrees to pay any fluctuations where applicable. It shall be the responsibility of the Customer to check that there have been no changes to the Price before making full and final payment. However, once payment of the Price in full is received, the Price is guaranteed. Airfares are subject to the price and conditions quoted by the airlines and cannot be guaranteed by us.
In the event that the Customer is a group booking and the group number varies from the original number at the time of booking. The Supplier may re-quote the Price and add an extra charge. If anyone refuses to pay the surcharge, the entire booking may be cancelled and any payment made may be withheld. We shall be entitled to retain fees for services. Sometimes Suppliers ask for an additional clause due to fuel price increase even if it has already been paid for.
Liability, Limitation of Liability and Indemnity.
The Proposed Travel Arrangement is made on the express condition that Knap Tours, our employees and travel agents, shall not be liable and shall be exempt from all liability. In the event of loss, damage, accident, injury, illness, illness, trauma, death, delay or additional expense incurred by any Client, their luggage, or other property, whether or not caused by any act, omission, default or negligence on our part.
9. TRAVEL DOCUMENTS
Documents such as vouchers, vouchers, booking numbers, complete itineraries, etc. are only prepared and released upon receipt of payment of the contracted tour price in full. The Client, upon receipt, is responsible for checking that all details are correct.
10. PASSPORTS, VISAS AND HEALTH
It is the obligation and responsibility of the Client to ensure that all passports and visas are up to date, have been obtained on time, and are valid for six months after the date of return to the country. Knap Tours undertakes to assist the Customer, but this assistance will be at the discretion of the Travel Agent. The Client acknowledges that, in doing so, Knap Tours assumes no obligation or liability.
All visitors to Africa and all Clients travelling from Africa to another country are required to have two consecutive sides of blank visa pages. That is, a left and right page, excluding the front and back cover for the visa to be issued.
If a passport does not comply with these requirements, it will not be allowed on board or may be deported on arrival. Hence, The Customer must ensure that the details provided to Knap Tours reflect the details that appear in their passport for international travel. In addition, return documentation is mandatory and it is the sole responsibility of the Client to ensure that all documentation is in order prior to departure.
11. MALARIA AND OTHER TROPICAL DISEASES
Certain parts of your itinerary may be areas where there is a high risk of malaria and other tropical diseases. We strongly recommend that you take the necessary precautions in this regard, and you should consult your doctor before departure. If the Client has not done so prior to departure, it is recommended that they does so upon return.
12. YELLOW FEVER
Some countries in South Africa require a yellow fever vaccination certificate. Requirements vary depending on your destination, country of origin, and previously visited countries.
Clients travelling from the following countries or visiting these countries together with other Southern African countries will need proof of yellow fever vaccination: Angola, Argentina, Benin, Bolivia, Brazil, Burkina Faso, Burundi, Cameroon, Central African Republic, Chad, Colombia, Congo, Ivory Coast, Democratic Republic of Congo, Ecuador, Equatorial Guinea, Ethiopia, Guyana, Gabon, Gambia, Ghana , Guinea, Guinea-Bissau, Guyana, Kenya, Liberia, Mali, Mauritania, Niger, Nigeria, Panama, Paraguay, Peru, Rwanda, Sao Tome and Principe, Senegal, Sierra Leone, Somalia, Sudan, Suriname, Togo, Trinidad and Tobago, Uganda, the United Republic of Tanzania and Venezuela.
Administer the yellow fever vaccination at least 10 days prior to departure. It is the responsibility of the Client to check with the relevant embassy of their intended destination.
13. CANCELLATION
Knap Tours reserves the right to cancel any tour prior to departure, in which case full payment will be refunded to the Client without any further obligation on the part of Knap Tours. Moreover, The maximum cancellation fee that may be imposed in the event of cancellation by the Client is as follows:
Cancellation before 30 days prior to commencement of the tour – 25% forfeited.
Cancelation between 30 and 15 days before the start of the trip – 50% of the cost of the trip is forfeited.
Cancellation between 14 and 8 days before the start of the trip – 75% of the cost of the trip is forfeited.
Cancelation less than 7 days before the start of the trip – 100% of the cost of the trip is forfeited.
* Flights will be forfeited in any of the above 4 options.
Please note that some of our suppliers’ cancellation policies may be stricter than our policy above. Knap Tours has the right to pass on such additional cancellation charges to the Customer. Provided the Suppliers agree to a refund in excess of the Knap Tours Terms and Conditions of Cancellation, the Customer will receive such amount.
14. UNSCHEDULED EXTENSIONS
In the unlikely event that the extension is not scheduled in the final itinerary, and is caused by flight rescheduling, flight delays, bad weather, strikes or any other cause beyond the control of Knap Tours. Expenses related to these unscheduled extensions (accommodation, etc.) shall be borne by the Client.
15. ITINERARY VARIATIONS
Knap Tours reserves the right to make changes for the ultimate convenience of the Client. For example, weather conditions may require a change in the itinerary and this does not constitute grounds for a refund.
16. APPLICABLE LAW AND JURISDICTION
British legislation and the jurisdiction of the British courts will govern the relationship between the Client and Knap Tours. Knap Tours shall have the right to bring an action in court in any court of first instance, notwithstanding that the amount in question may exceed the limits of that jurisdiction. This Agreement will be governed by the laws of the United Kingdom and will be enforced by the courts of the United Kingdom. If Knap Tours has to take legal action against you to enforce payment of amounts due, you shall be responsible for paying all costs that Knap Tours incurs in making payment.
If Knap Tours is unable to perform all or any of its obligations under this Agreement due to an event beyond its control, Knap Tours will be released from its obligations under the Agreement for the period such event and its consequences continue, but only to the extent prevented and shall not be liable for any delay or failure to perform such obligations or loss or damage you may suffer as a result of such delay or failure.
17. SPECIAL REQUIREMENTS AND NEEDS
Clients who have special requirements and needs should specify such requirements and needs to Knap Tours. While every effort will be made to accommodate them, no guarantee is given.
18. RECTIFICATIONS
No modification, cancellation, rectification or waiver of any term or right referred to herein shall be deemed valid or binding. Unless in writing and signed by the Customer and a duly authorized representative of Knap Tours.
19. REFUND AND CHANGES
No refunds will be accepted under any circumstances by Knap Tours. Refunds will be subject to the Terms and Conditions. Generally, refunds may take up to eight weeks; however, in exceptional cases, they may take even longer.
20. FORCE MAJEURE SITUATIONS
Knap Tours has the right to cancel any contract if its performance is prevented, hindered or frustrated by strike, lockout, civil commotion, war, acts of God, lack of materials, law or regulations, order issued by authorities duly constituted by law or any other cause beyond the control of Knap Tours.
Force Majeure includes renovations that may be carried out to the accommodation. Moreover, The travel agent will make every effort to provide updated information in this regard, and the accommodation will make every effort to avoid and minimize any inconvenience caused. However, A refurbishment or renovation being carried out does not constitute grounds for any claim against us.
Knap Tours will always make every effort to recover, where necessary, any money paid on behalf of the Client from the involved parties. All recovered monies will be refunded to the Client, less a 10% (ten percent) fee.
21. RESERVATIONS ON THE INTERNET
If the Customer requests or instructs Knap Tours to make bookings via the Internet. The customer irrevocably authorizes Knap Tours to do the following on his/her behalf (1) make selections from and for his/her Travel Proposal (2) make payments and (3) accept the booking conditions.
22. DRIVER’S LICENCE
Even when obtaining an International Driving License, the Customer must carry his National Driving License with him. The Customer is aware that South African drivers drive on the left-hand side of the road.
23. CONFIDENTIALITY
While adhering to legal restrictions, we commit to handling all personal customer information with the strictest confidence.
24. RATES AND SURCHARGES
All prices will include airport and airline taxes, fees, and surcharges whenever possible. Please note that some airlines may impose additional taxes and/or surcharges for ticket changes, even if the ticket has been paid in full.

26. CONSUMER PROTECTION LAW
We support the intent of the Consumer Protection Act. Moreover, Business interactions between a seller and a buyer regarding products or services consumed in South Africa are governed by specific regulations. We believe in honest, transparent, ethical and fair business practice.
27. CHANGES TO THE TERMS AND CONDITIONS
Finally, The Company reserves the right to make changes to the Terms and Conditions at any time without notice.
